Ivan,

The truth lies in between...

For example the MAX3222 datasheet from TI says: "C3 can be connected to VCC
or GND". Same applies for the Sipex SP3222 and Maxim 3222 datasheets. So for
those three chips the circuit is correct as you can use either VCC or GND.
