I did get it to work, using NutTcpSend.
Not sure if it was a timeout issue. 
I did montior another Modbus TCP devices communications and it did respond with data in its first segment....led me down the path I was on.

May be I didn't get you right...

The application code will not notice any of the ACKs.
It's completely handled internally by the TCP Stack.
This is true for Ethernut as well as for your PC
application.

In your trace it looks like the PC closes the
connection after 1 second without data. Timeout?
